MEMBERSHIP & ELIGIBILITY
You can sign up for an account by registering and creating an “Account.” You may use the Services to make purchases only if you are 18 years or older and capable of forming a binding contract with us. Except as permitted in this paragraph, you may not reproduce, modify, display or otherwise make commercial use of any content from the SkyPots website unless expressly permitted by SkyPots. PAYMENTS
When you make a purchase through our Services, you authorize us or our third party payment processor to charge your payment method for any such purchases (plus any applicable taxes and other charges) that may be accrued by or in connection with your purchase. You are responsible for the timely payment of all fees and for providing a valid method of payment. All prices, fees and any applicable taxes and other charges are payable in your selected currency at checkout. When you initiate a purchase transaction via the Services, you will be asked to provide customary billing information such as your name, billing address, and credit card information. INTERNATIONAL ORDERS
Customers who access and use the skypots.com website from outside the United States are responsible for complying with their local laws and regulations. When you place an order and select a shipping address outside of the United States you or your designated consignee are the Importer of Record and as such are authorizing SkyPots to import the goods to your destination country on your behalf. Furthermore, you agree that SkyPots may delegate the obligation to import the goods on your behalf to a subcontractor (e.g. customs broker). When indicated on the website, SkyPots through its own or 3rd party software tools will make its best effort to calculate and collect the applicable duties and taxes and any other additional fees up front, either at Checkout or included in the product price, but ultimately you or your designated consignee as Importer of Record are responsible to pay the applicable duties & taxes and any other import fees to your local customs authorities.
INTELLECTUAL PROPERTY RIGHTS
All graphics, images and content on the http://www.skypots.com website belong exclusively to SkyPots, or its affiliates. The use of any SkyPots trademarks or service marks without SkyPots’ express written consent is strictly prohibited. You may not use SkyPots trademarks or service marks in connection with any product or service that is in any way likely to cause confusion or to disparage or discredit SkyPots. In addition, you may not use any of SkyPots’s trademarks or service marks in meta tags without SkyPots’ explicit prior consent.

ERRORS
Accidents happen. In the event that a product is listed incorrectly (e.g. price or description) due to a typographical error or other mistake, we reserve the right to refuse or cancel any orders that may have been placed for such a product listed. If your credit card has already been charged for such an erroneous purchase, we shall issue a credit to your card for the full amount of the charge.

Any dispute relating in any way to your visit to the http://www.skypots.com website or products purchased on http://www.skypots.com shall be submitted to confidential arbitration in San Diego, California, except in regards to issues regarding violations of SkyPots’s intellectual property rights, which we may seek relief from in any state or federal court in the State of California. By using the http://www.skypots.com website, you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of California.
By using http://www.skypots.com you agree that SkyPots’ remedy at law for any actual or threatened breach of these Terms of Use would be inadequate. As such, SkyPots shall be entitled to specific performance, injunctive relief, or both, in addition to any damages that we may be entitled to recover, along with our reasonable expenses for any form of dispute resolution, including, without limitation, our attorneys’ fees. No right or remedy of ours shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys’ fees and expenses.
SEVERABILITY
If any the provisions in these Terms of Use are deemed invalid or otherwise unenforceable, that condition shall be deemed several and shall not affect the enforceability of the remaining provisions.
